These Terms and Conditions govern your access to and use of the Estella Real Estate website, forms, communications, and related services.
In these Terms, “Estella Real Estate,” “we,” “us,” and “our” refer to Estella Real Estate. “You” and “your” refer to the person accessing the website, submitting information, communicating with us, or otherwise using our services.
By accessing our website, submitting a form, requesting an offer, or otherwise using our services, you agree to these Terms and Conditions and our Privacy Policy.
Estella Real Estate is a real estate investment business that evaluates land and other real property for potential purchase.
We may:
Review information about a property
Contact property owners
Research public and commercial property information
Request additional documents or information
Discuss possible purchase terms
Make a possible offer
Conduct due diligence
Enter into a written purchase agreement when mutually acceptable
We are not required to make an offer, purchase a property, continue negotiations, or accept any proposed terms.
Unless expressly stated in a separate written agreement, Estella Real Estate acts as a prospective principal buyer or real estate investor.
We do not act as your:
Real estate agent
Real estate broker
Attorney
Accountant
Tax adviser
Financial adviser
Appraiser
Lender
Fiduciary
No agency, brokerage, partnership, joint venture, employment, or fiduciary relationship is created by your use of the website, submission of property information, or communications with us.
You are encouraged to obtain independent legal, tax, financial, title, valuation, and real estate advice before entering into a property transaction.
A request for an offer is an invitation for us to evaluate a property. It is not an agreement to purchase or sell the property.
Any preliminary figure, estimated value, verbal statement, text message, email, letter, or informal proposal is nonbinding unless it is incorporated into a definitive written agreement signed by all required parties.
A potential offer may depend on:
Verification of ownership
Clear or acceptable title
Property condition
Access
Survey information
Taxes and assessments
Liens and encumbrances
Zoning and land-use restrictions
Utilities
Environmental conditions
Market conditions
Available financing
Inspection or due diligence
Approval by the necessary parties
Other property-specific considerations
Only a fully executed written agreement creates binding transaction obligations.
Submitting a website form, requesting information, communicating with us, or receiving a potential offer does not require you to:
Sell your property
Accept an offer
Sign a purchase agreement
Pay Estella Real Estate a fee
Continue negotiations
You may decline a potential offer unless you have already entered into a binding written agreement.
You agree that information you provide will be accurate and complete to the best of your knowledge.
You represent that you are:
The property owner;
An authorized representative of the owner; or
Otherwise authorized to request information about the property.
You agree not to knowingly provide false, deceptive, fraudulent, or misleading information.
You should inform us of known issues that may materially affect the property or a potential transaction, including ownership disputes, probate matters, liens, unpaid taxes, mortgages, boundary disputes, access problems, environmental conditions, pending litigation, bankruptcy, or existing contracts.
We may rely on information you provide while reserving the right to independently verify it.
By using the website or contacting us electronically, you consent to receive communications from us electronically, including through email, website messages, and electronic documents.
You agree that electronic communications may satisfy legal requirements that a communication be in writing, except when applicable law specifically requires another method or a separately signed agreement.
Electronic communications do not create a binding property sale unless the parties execute a written agreement satisfying applicable legal requirements.
When you affirmatively opt in to receive text messages, Estella Real Estate may send SMS or MMS messages concerning:
Your property
Your request for information or an offer
Questions about property details
Potential offers
Follow-up communications
Appointments
Transaction updates
Related marketing or promotional communications disclosed at the time of consent
By checking the applicable consent box, submitting the opt-in form, or otherwise providing valid consent, you authorize Estella Real Estate to send text messages to the mobile telephone number you provide.
Messages may be sent through an automated messaging system or other messaging technology when permitted by law.
Your consent is not a condition of receiving an offer, selling property, or purchasing any goods or services.
You represent that:
You are the subscriber or customary user of the mobile number provided;
You are authorized to consent to messages at that number; and
The number you provide is accurate.
You agree to notify us if you stop using or controlling that telephone number.
Message frequency varies depending on your inquiry, property, communications, and transaction status.
Message and data rates may apply according to your wireless carrier and mobile plan. Estella Real Estate does not charge a separate fee for text messages, but your carrier may charge you.
You may opt out of text messages at any time by replying STOP.
We will also make reasonable efforts to honor other clear withdrawal requests communicated to us, including requests made by email or telephone.
After opting out, you may receive one final text message confirming that your opt-out request has been processed.
For assistance, reply HELP, email jcabrera@estellarealestate.com, or call 210-871-0623.
Wireless carriers are not responsible for delayed or undelivered messages.
Text-message delivery is subject to effective transmission by your mobile carrier and messaging providers. Delivery is not guaranteed.
We do not sell, rent, or disclose mobile phone numbers, SMS opt-in information, or messaging consent records to third parties or affiliates for their own marketing or promotional purposes.

Our collection and use of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
Unless applicable law requires otherwise, any lawsuit arising solely from use of the website or these Terms must be brought in a state or federal court with jurisdiction in Hidalgo County, Texas. You consent to the personal jurisdiction of those courts.
This section does not replace the governing-law, venue, mediation, or dispute provisions contained in a separately executed property agreement.
We may revise these Terms periodically.
When changes are made, we will publish the updated Terms and revise the “Last Updated” date. Changes take effect when posted unless another effective date is stated.
Your continued use of the website after revised Terms are posted constitutes acceptance of the revised Terms.
Changes to these website Terms do not retroactively alter a separately executed property agreement.
If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be enforced to the greatest extent permitted, and the remaining provisions will remain in effect.
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or another provision later.
These Terms and the Privacy Policy constitute the entire agreement concerning general use of the website.
A separately executed property purchase agreement, assignment, option, closing document, confidentiality agreement, or other written contract may contain additional or different terms. When there is a conflict concerning a specific property transaction, the separately executed agreement will control.
